2. Purpose of the privacy policy

Data protection and the privacy of Users are very important to Kronos Partners AG. Kronos Partners AG complies with the applicable data protection laws and regulations, in particular the Swiss Data Protection Act (hereinafter "FADP"). Kronos Partners AG is a Swiss company that operates in the B2B sector. Therefore, the General Data Protection Regulation of the European Union (hereinafter "GDPR") is not applicable. Kronos Partners AG treats all personal data (hereinafter "personal data") confidentially. Personal data is any information relating to an identified or identifiable natural person. This privacy policy shows how Kronos Partners AG handles personal data - already collected and in the future - and explains in particular which personal data of the User is processed and for what purposes this personal data is processed. Kronos Partners AG is responsible for the processing of personal data.

Kronos Partners AG receives personal data about Users, e.g. when they access the Website or contact Kronos Partners AG by phone, e-mail or in any other way.

Personal data transmitted by the User to Kronos Partners AG may be used by Kronos Partners AG as follows:

Access to personal data is limited to those employees of Kronos Partners AG and sales and co-operation partners who need to know this data. The persons and companies concerned are obliged to maintain confidentiality and to comply with the valid and applicable data protection laws. Under no circumstances will Kronos Partners AG sell or otherwise commercialise personal data to third parties without the express consent of the User. The rights of the User with regard to the processing and transfer of his/her personal data to third parties in accordance with the applicable data protection laws shall be safeguarded.

Insofar as Kronos Partners AG is obliged to do so by law or by court order, Kronos Partners AG shall transmit personal data to bodies authorised to receive such information. For the provision of services by sales or cooperation partners or by external third parties who provide services for Kronos Partners AG, personal data may also be disclosed abroad (i.e. also in countries without corresponding data protection legislation) and processed there within the scope of these provisions. Kronos Partners AG shall take reasonable steps to ensure that personal data is processed, secured and transferred in accordance with applicable law.

Kronos Partners AG will retain Users' Personal Data for as long as is necessary for the purposes for which it was collected, in particular for the fulfilment of contractual and legal obligations, the maintenance of accurate accounting, financial and other operational records, the resolution of disputes and the enforcement of Kronos Partners AG's rights in connection with the use of the Website. The data will be deleted or anonymised as far as possible within twelve months of the respective purpose ceasing to apply.

7. Publication of personal data

  • the disclosure is necessary for the assertion, exercise or defence of legal claims and there is no reason to assume that the User has an overriding interest worthy of protection in the non-disclosure of their data;

  • there is a legal obligation to disclose the data;

  • there is an overriding private or public interest; or

  • this is legally permissible and necessary for the fulfilment of contractual relationships with the User.

Personal data will not be passed on to third parties for purposes other than those listed above. A transfer of personal data to third parties takes place, for example, through the transmission of credit card data to the processing banking institutions or payment service providers for the purpose of debiting the purchase price (billing purposes), through the dispatch of products or information or through the provision of customer service. In addition, personal data is transferred in connection with the web analysis services listed below. Third parties only have access to the User's personal data to the extent that this is necessary to fulfil their tasks. These service providers are obliged to treat the personal data in accordance with the applicable data protection laws.

If Kronos Partners AG has made the personal data relating to the User public and Kronos Partners AG is obliged to delete it (see section 18 below), Kronos Partners AG shall take appropriate measures, including technical measures, taking into account the available technologies and the implementation costs, to inform those persons who have received and process the personal data that the User has requested the deletion of all links to this personal data or of copies or replications of this personal data. Furthermore, Kronos Partners AG is obliged to inform the User - at his request - about the recipient of his personal data.

Kronos Partners AG may transfer the processing of personal data by contract or by law to a processor, i.e. a private person or a federal body that processes personal data on behalf of Kronos Partners AG, if:

  • the personal data is processed in the same way as Kronos Partners AG is authorised to do; and

  • no legal or contractual confidentiality obligation prohibits the transfer.

Kronos Partners AG ensures that the processor is able to guarantee data security.

8. International transfer of personal data

Users' personal data is generally stored in databases within Switzerland. Under certain circumstances, however, it is necessary for Kronos Partners AG to transfer personal data to countries outside Switzerland, the European Union (EU) or the European Economic Area (EEA), so-called "third countries". Transfers to third countries may include all processing activities described above. These provisions also apply if personal data is transferred to third countries in which a different level of data protection prevails than in the User's country of residence. Any transfer of personal data to third countries only takes place with the User's knowledge and, where applicable, prior consent.

Any transfer of personal data to countries whose data protection is not recognised as adequate by the Federal Data Protection and Information Commissioner (FDPIC) takes place on the basis of contractual agreements, such as the model contract defined by the FDPIC for the outsourcing of data processing abroad, or on the basis of other guarantees that comply with the applicable law.

9. Cookies

When Users visit the Website, information such as IP addresses, browser types, domain names and other statistical data about the use of the Website may be automatically stored on their devices (computer, laptop, tablet, smartphone, etc.). This takes place in the form of so-called "cookies" or a similar file. This data is collected in order to learn the preferences of Website Users, to ensure that the Website is provided without errors and to analyse User behaviour in order to optimise the Website. Google Analytics is a web analytics service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"). Google Analytics uses "cookies", which are text files placed on the User's computer, to help the Website analyse how Users use the site. The information generated by the cookie about the use of this Website (including the User's IP address, duration of use, frequency of visits to the Website, etc.) is transmitted to a Google server in the USA and stored there. Due to this setting, Google shortens the IP addresses collected within member states of the European Union or in other signatory states to the Agreement on the European Economic Area before storing them. Kronos Partners AG uses Google Analytics on the Website with the functions of Universal Analytics. This allows Kronos Partners AG to analyse the activities of the Website across devices (e.g. if the Website is accessed via laptop and later via smartphone). This is made possible by the pseudonymous assignment of a User ID to a User. This happens, for example, when the User registers for a User account or logs into their User account. No personal data is forwarded to Google. The additional functions of Universal Analytics do not restrict the aforementioned data protection measures.

The data collected by Google Analytics is stored for as long as is necessary to analyse the Website. The data is automatically deleted after a period of 50 months at the latest.

Facebook is a social network of the American company Facebook, Inc. based in Menlo Park, California, USA. LinkedIn is a web-based social network for maintaining existing business contacts and making new business connections from LinkedIn Inc. based in Sunnyvale, California, USA. Instagram is an ad-supported online service for sharing photos and videos that belongs to the American company Facebook, Inc. When Users access the Website of Kronos Partners AG, their browser establishes a direct connection with the servers of the before mentioned providers and the respective button is loaded from there. The information that the corresponding Website has been accessed is transmitted to the respective provider. If the User is a registered User of the relevant service, the provider can also assign the page view to the corresponding profile and may collect further data.

On these social networks, Kronos Partners AG regularly publishes and shares content, offers and product recommendations. The type, scope and purposes of data processing in the social networks are primarily determined by the operators of the social networks. 12. Newsletter and personalised product recommendations

Kronos Partners AG offers the User a newsletter service. The User receives information on the topics covered in the newsletter and further information by registering for the newsletter service. When using the newsletter, Kronos Partners AG also collects the User's device and access data. To subscribe, the User must register with their e-mail address, first name and surname and confirm in an e-mail sent by Kronos Partners AG that they wish to subscribe to the newsletter service ("double opt-in process"). If this registration confirmation is not received within ten days, Kronos Partners AG will delete the e-mail address again and registration will not have taken place. Only after confirmation by the User will the e-mail address used for this purpose be stored permanently until the User unsubscribes from receiving the newsletter or is deleted by Kronos Partners AG. The User can unsubscribe from the newsletter at any time. An unsubscribe link is included in every email containing the newsletter.

For the newsletter service, Kronos Partners AG uses the newsletter service Mailchimp of Rocket Science Group LLC in Atalanta USA. Kronos Partners AG draws the User's attention to the fact that the data collected and used via Mailchimp is stored and processed on computers in the USA. By consenting to receive the newsletter, the User hereby agrees to this.

The newsletter from Kronos Partners AG does not contain any obvious or hidden counters, third-party advertising or links to third-party Websites that are not directly related to the content of the newsletter.

The e-mail address is collected for the purpose of sending the newsletter. Additional personal data is used to prevent misuse of the services or the e-mail address used. By submitting the newsletter registration form, the User consents to data processing for the purposes of sending the newsletter. The User agrees that a newsletter may be sent regularly to the email address provided and that User behaviour may be statistically evaluated in order to optimise the newsletter. Kronos Partners AG is authorised to pass on the User's data to third parties for the technical processing of the newsletter.

Kronos Partners AG presents the User with information and offers from Kronos Partners AG based on the User's interests. The User receives these personalised product recommendations regardless of whether they have subscribed to a newsletter. For the selection of personalised product recommendations, Kronos Partners AG primarily uses the User's previous purchase data and interest data in accordance with the statutory provisions, from which the User's product interests are derived, taking into account the interests, preferences and profile data communicated by the User.

Kronos Partners AG uses the User's personal data for personalised advertising, which is presented to the User on the Website and in the app. Standard internet technologies are used for this purpose. Kronos Partners AG is obliged to verify the identity of the User for such enquiries. Enquiries can therefore only be processed if suitable proof of the User's identity (copy of identity card or similar) is enclosed. If the data processing is based on consent, the User also has the right to withdraw consent from Kronos Partners AG at any time. As a result, Kronos Partners AG may no longer continue the data processing based on this consent in the future.

If the User uses the contact form, the following User data will be transmitted to Kronos Partners AG and stored: first and last name, e-mail address and enquiry text.
